• All platform features and functionalities
• Our proprietary algorithms and systems
• The user interface and experience design
• All documentation and supporting materials

Your Rights

Kliv makes no claim to ownership of:

• All code generated using our Services
• Applications and solutions built using our platform
• Custom implementations and modifications
• Your business logic and application structure

Usage Rights

You have the right to:

• Use generated code commercially without restrictions
• Modify and adapt generated code freely
• Distribute generated code in any form
• Sell applications built using our platform
• Open source your implementations without attribution requirements

Data Usage, Training, and Learning

We collect and process data from your use of the Services to improve our platform, provide support, and enhance user experience. Our Privacy Policy contains detailed information about data collection and processing.

Service Improvement and Training

Your use of our platform contributes to its continuous improvement. We analyze generated code, prompts, and usage patterns to enhance our AI systems. We specifically use this data to:

Enterprise Plan Considerations

Enterprise customers receive enhanced data protection. We explicitly waive our right to use Enterprise data for training purposes, and custom data handling agreements are available.

• Account deletion must be requested via support

Prohibited Uses

You explicitly agree not to:

Kliv may never be used to develop anything subject to sanctions or export restrictions, or in any way not compliant with applicable laws. Kliv may also never be used in regions or by anyone subject to sanctions or export restrictions.

Reporting Abuse and Copyright Infringement

We rely on a notice-based moderation model. To report a published site or account that you believe violates these Terms, please use the appropriate channel:

• Abuse, phishing, malware, fraud, or impersonation: see Report Abuse or email abuse@kliv.dev.
• Copyright infringement (DMCA): see our DMCA Copyright Policy for the procedure and required elements of a notice. Notices may be sent to our designated agent at abuse@kliv.dev.
• Trademark and other intellectual-property claims: email abuse@kliv.dev with the same level of detail as a DMCA notice.

We act expeditiously on substantially compliant notices. Users who repeatedly host infringing or abusive content are subject to suspension or termination consistent with our DMCA repeat-infringer policy.

Disclaimer of Warranties

YOUR USE OF THE SITE, SERVICES AND ALL KLIV CONTENT IS ENTIRELY AT YOUR OWN RISK. THE PLATFORM, SERVICES, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY GUARANTEES. TO THE FULLEST EXTENT PERMITTED BY LAW, KLIV AND OUR SUPPLIERS EXPLICITLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Limitation of Liability

KLIV, ALONG WITH ITS AFFILIATES, AGENTS, OFFICERS, EMPLOYEES, SUPPLIERS AND LICENSORS, SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE OUR PLATFORM, SERVICES, OR KLIV CONTENT. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM.
