Introduction
Rational Ventures, Inc. ("Kliv", "we," or "us") respects the intellectual-property rights of others and complies with the United States Digital Millennium Copyright Act ("DMCA", 17 U.S.C. § 512). This policy explains how copyright owners (or their authorized agents) can submit a notice of claimed infringement, how affected users can submit a counter-notification, and our policy on repeat infringers.
Designated Copyright Agent
Notices of claimed copyright infringement must be sent to our designated agent:
DMCA Designated Agent
Rational Ventures, Inc.
848 N Rainbow Blvd #3037
Las Vegas, NV 89107-1103
United States
Email: abuse@kliv.dev
Our designated agent is registered with the United States Copyright Office under 17 U.S.C. § 512(c)(2) (Registration No. DMCA-1072251).
Filing a DMCA Notice
To be effective under the DMCA, your written notice must include all of the following (17 U.S.C. § 512(c)(3)(A)):
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single online site are covered by a single notification, a representative list of such works).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, in sufficient detail to permit us to locate the material — typically the full URL of the page or file.
- Information reasonably sufficient to permit us to contact you, including your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
Incomplete notices may delay our response. We may, but are not required to, contact senders to request missing information.
Misrepresentation. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing — or that material was removed or disabled by mistake or misidentification — may be liable for damages, including costs and attorneys' fees. Do not file false or abusive claims.
Our Response
Upon receipt of a substantially compliant notice, we will:
- Expeditiously remove or disable access to the material identified in the notice;
- Notify the affected user and forward a copy of the notice;
- Apply our repeat-infringer policy described below.
Counter-Notification
If you believe your material was removed or disabled in error or as a result of misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g) to the designated agent above. Your counter-notification must include all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number; a statement that you consent to the jurisdiction of the United States Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Kliv may be found); and a statement that you will accept service of process from the person who provided the original notice or an agent of that person.
Upon receipt of a substantially compliant counter-notification, we will forward a copy to the original complainant. If we do not receive notice within 10 to 14 business days that the complainant has filed an action seeking a court order to restrain the alleged infringement, we may restore the removed material.
Repeat-Infringer Policy
Consistent with 17 U.S.C. § 512(i), Kliv has adopted and reasonably implements a policy that provides for the termination, in appropriate circumstances, of users who are repeat infringers. We may also suspend or terminate accounts in cases of clear or egregious infringement at our sole discretion, regardless of the number of prior notices.
No Pre-Screening
Kliv is a hosting and application-building platform. We do not pre-screen user content for copyright compliance. We rely on the DMCA notice-and-takedown process and on rights holders to identify allegedly infringing material.
Trademark and Other Intellectual-Property Claims
For complaints concerning trademark, trade-secret, right-of-publicity, or other non-copyright intellectual-property rights, please write to abuse@kliv.dev with the same level of detail as a DMCA notice (identification of the right, the allegedly infringing material, your authority to act, and your contact information). We review all such complaints promptly.
Service Outside the United States
The DMCA is a U.S. statute. Rights holders located outside the United States may submit notices to the same designated agent using the same format; we apply the DMCA framework to all qualifying notices regardless of the rights holder's location.
Changes to This Policy
We may update this policy from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be reflected by a new effective date.
